THE SANITARY DISTRICT OF CHICAGO IN THE SUPREME COURT OF THE UNITED STATES
Abstract
The so called "Chicago Drainage Canal" or more properly the "Chicago Sanitary and Ship Canal," has been the subject of three very interesting litigations:
First, the case of State of Missouri v. State of Illinois and Sanitary District of Chicago, tried before the United States Supreme Court in 1903;
Second, the case of United States v. Sanitary District of Chicago, tried before the federal court for the northern district of Illinois from 1909 to 1916, and appealed to the Supreme Court where a decision was rendered in 1925;
Third, the case of State of Wisconsin et al. v. State of Illinois and Sanitary District of Chicago et al., tried before the Supreme Court with former Justice Charles Evans Hughes as Special Master.
A proper understanding of the conditions leading to these litigations requires a brief historical review, prefaced by a description of the topography of the territory involved.
