CONTRACTS-CONTRACTORS' BONDS-SUIT BY MATERIALMAN AS BENSFICIARY
Abstract
A highway contractor's bond, given to a county, contained the following language: "* * * the condition of this obligation is * * * that * * * the * * * 'principal' * * * shall save harmless the county of Greene from * * * any liability for payment of wages due or materials furnished, * * * and shall well and truly pay for all material furnished*** (for) the* * * highway." An unpaid materialman, suing the compensated surety on this bond, was denied recovery in Greene County v. Southern Surety Co., 292 Pa. 304, 141 Atl. 27 (1928).
